Dear Mr. Bellerose,

This is in reference to the procedural request submitted on 10 June 2022 by Bellerose média-conseil inc., on behalf of Arsenal Media inc. (Arsenal). In that letter, Arsenal requested that, if the Commission were to keep the 6 June 2022 reply submitted by Josyanne Cossette, on behalf of a corporation to be incorporated (Ms. Cossette) on the public record, the Commission allow all interveners a ten-day period to respond to such reply.

On 15 June 2022, Ms. Cossette responded to Arsenal’s request, arguing that her reply should be left on the public record and no further delays should be allowed.
Commission staff notes that the procedure set out in CRTC 2021-376 explained that only parties that file interventions may file a reply to matters raised during the intervention phase. Ms. Cossette, a party to the proceeding, did not file an intervention. Nevertheless, Ms. Cossette filed a reply on 6 June 2022, which included two reports, in response to an intervention by Cogeco Média inc. (Cogeco).

Ms. Cossette’s reply is out of process and also adds a significant amount of additional information during what should be the close of record. Nevertheless, Ms. Cossette’s reply will be admitted on the record of the proceeding. However, considerations of fairness require that all interveners be allowed to comment on a final basis to this reply within a reasonable period of time.

Accordingly, parties who filed an initial intervention (namely Cogeco, Bell Media, and Arsenal) may submit final comments but must limit their comments to the matters raised in Ms. Cossette’s reply on or before 30 June 2022.

Commission staff notes that this is a firm and final deadline, after which the record of the proceeding will be closed. This means that that no other submissions will be accepted after the deadline.

A copy of this letter and all related correspondence will be added to the public record of the proceeding.
