RE: Notice of New Part 1 Application entitled Novus Entertainment Inc. (Novus) Application for Non-Discriminatory and Timely Access to the Multi-Dwelling Unit (MDU) Development Telford and other Developments of Westland Living (Westland) and its Related Companies

Dear Austin Zhang,

On 29 October 2021, the Canadian Radio-Television and Telecommunications Commission (CRTC) received a new application initiated by Novus and filed under Part 1 of the Canadian Radio-Television and Telecommunications Commission Rules of Practice and Procedure(the Rules of Practice and Procedure). 

In its Part 1 application, Novus is seeking relief from what it submitted is its ongoing inability to obtain timely access, under reasonable terms and conditions, to the MDU developments of Westland.  These developments include:

Subsection 25(1) of the Rules of Practice and Procedure state that the respondent to a Part 1 application (Westland) may file their answer with the CRTC within 30 days of the date on which the CRTC posts the application on its website (link: All Public Proceedings Open for Comment).  Westland’s response will be placed on the public record for this proceeding.  The public also has 30 days to submit interventions relating to the Part 1 application and the applicant then has 10 days to reply, after which the record closes to comments.  The Commission then examines all of the written submissions and issues a decision.

Novus’ application was posted to the CRTC’s website on 5 November 2021.  Westland may file its response to Novus’ application with the CRTC by 6 December 2021.  

Please provide confirmation to the CRTC in writing by no later than 6 December 2021 should Westland decide not to file a response.  

Submissions to the CRTC must be filed in accordance with the procedures set out on the CRTC website, including ensuring that all correspondence is addressed to the Secretary General (Mr. Claude Doucet).  All documents must be submitted no later than 5:00 p.m. (PST) (8:00 p.m. EST) on the deadline date.

In addition to filing its response with the CRTC, Westland is required to serve a copy of its response directly on Novus.  Please be advised that the responsibility for serving Novus with a copy of Westland’s response rests with Westland.
