On 11 November 2021 the Deaf Wireless Canada Consultative Committee (DWCC) and the Canadian National Society for the Deaf-Blind, Inc. filed requests to extend the deadline for costs award applications in the Telecom Notice of Consultation 2021-178 proceeding (the proceeding).
On 12 November 2021, the Deaf and Hard of Hearing Coalition (comprised of Deafness Advocacy Association Nova Scotia, Newfoundland and Labrador Association of the Deaf, and Ontario Association of the Deaf) filed a letter in support and also sought an extension of the deadline.
These parties provided various reasons including the length of the proceeding, the complexity of the record and the accessibility needs of the requesters.
Commission staff notes that, given the issues under consideration in the proceeding, further process may still be needed. For instance, it may be necessary to issue further requests for information to certain parties and to allow other parties to comment on the responses.
For this reason, Commission staff considers that it would be reasonable for parties intending to file costs award applications not to file their applications until after (i) any further process has concluded; or (ii) Commission staff confirms, via letter, that the record of the proceeding has closed.
Commission staff intends to provide additional guidance to parties on these procedural matters in the near future.
If a party has already filed its costs application and wishes to participate in any further process, it may file a supplementary costs application after that process has concluded.
