Re: Part 1 Application filed by Novus Entertainment Inc. (Novus) for non-discriminatory and timely access on reasonable terms and conditions to the multi-dwelling unit (MDU) development the Heights on Austin and future MDU developments of Beedie Construction and Living and its related companies (Beedie)

Dear Donna Robertson and Stephen Selznick:

On 1 March 2021, the Commission received a Part 1 Application from Novus, filed under Part 1 of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure. In the Application, Novus sought relief from what it submitted was its ongoing inability to obtain timely access on reasonable terms and conditions to Beedie’s MDU development known as the Heights on Austin, located in Coquitlam, British Columbia.

The Commission received letters from both Novus and Cassels Brock & Blackwell LLP (representatives of the Heights on Austin East) on 6 April 2021.  The parties requested that Novus’ Application be held in abeyance to allow time for the negotiation process for MDU access to continue.

On 26 Oct 2021, the Commission received a letter from Novus requesting that the Commission dismiss Novus’ application, as Beedie had provided Novus with executed installation access documents.
Commission staff advises that this Part 1 Application is now closed.
