Re:  Request to align and extend the intervention deadlines for various Tariff Notices associated with mandated MVNO access services, and notice that the applications will not be disposed of by the 45th business day following receipt

This is in response to Xplornet Communications Inc. and Xplore Mobile Inc., (together, “Xplornet”) 28 July 2021 letter requesting to align and extend the intervention deadlines for applications under Tariff notice 0372, 0005, 0006, 0072, 0563, and 0564, filed respectively by Bell Mobility Inc. (Bell Mobility), Rogers Communications Canada Inc. (RCCI), Saskatchewan Telecommunications (SaskTel), and TELUS Communications Inc. (TCI). Xplornet requested that the intervention deadlines associated with the applications be extended until 3 September 2021.

In its letter, Xplornet submitted that it is appropriate to align the intervention deadlines as interested parties must simultaneously assess the filings as a set and cannot be considered in a sequential manner. It further requested that the intervention deadlines be extended until 3 September 2021 since the applications are substantial, complex, and of critical importance to implementing the determinations set out in Telecom Regulatory Policy CRTC 2021-130, Review of mobile wireless services.

On 28, 29 and 30 July 2021 Bell Canada, Bragg Communications Incorporated, carrying on business as Eastlink (Eastlink), the British Columbia Broadband Association (BCBA), Cogeco Communications Inc. (Cogeco), Iristel Inc. (Iristel), on behalf of itself and its affiliate Ice Wireless Inc. (Ice Wireless), Quebecor Media Inc., on behalf of Videotron Ltd. (Videotron), RCCI, and TCI filed a reply to Xplornet’s request.

All parties supported Xplornet’s request to align and extend the intervention deadlines. All parties supported extending the intervention deadlines until 3 September 2021, except Bell Canada and TCI who further proposed extending the deadlines until 7 September 2021. TCI and Bell Canada submitted that extending the deadlines until 7 September 2021 would allow extra time for the filing of comments and eliminate the federal holiday from the amount of time allotted for reply comments.

Given the complexity of the files and benefits of aligning the deadlines, staff consider Xplornet’s request to align and extend the intervention deadlines for the applications to be reasonable. With respect to the new deadlines, staff considers that it is reasonable to extend the intervention deadlines until 7 September 2021, which would provide parties additional time to file interventions and consider the federal holiday. Applicants may file reply comments within 10 calendar days of the new deadline for filing interventions.

Additionally, given the number of applications and their complexity, the applications will not be disposed of by the 45th business day following receipt.
