RE: Broadband Fund - Community Engagement Report – Request for Disclosure

Dear Mr. Thompson:

This is further to our letter to you dated 12 February 20201 regarding Northwestel Inc.’s  (“Northwestel”) confidentiality claims in respect of its Community Engagement Report (the Report) filed with the Commission in response to the funding condition set out in Telecom Decisions 2020-257, 2020-258, 2020-259, and 2020-260. 

In its response dated 17 February 2021, Northwestel set out its reasons in support of its claim of confidentiality, but stated that it would provide any consultee with the confidential version of what it filed in relation to their community engagement. To that end, Northwestel stated that it was providing CYFN a version of the Report with the CYFN's redacted information.

Commission staff considers that any harm claimed by Northwestel associated with release on the public record of information concerning their engagement with affected communities, including Northwestel’s response, would not arise if the information were disclosed only to each consultee. Accordingly, Northwestel is to disclose to each of the various groups, governments and organizations with whom they met the information contained in its Report related to that engagement, including information concerning the persons and organizations with whom the company met, the description of any feedback and other comments provided to the company, and the response provided by Northwestel.

Northwestel is to provide a version of the Report with the respective consultees’ redacted information to each consultee by 5 March 2021. Commission staff asks that any feedback Northwestel receives with respect to the characterization of the engagement following the disclosures be filed with the Commission within 5 business days of receiving the feedback.
