Re: Application 2020-0704-6 by Ebox Inc. – Reopening of proceeding

Dear sirs,

On 21 October 2020, the Commission received a Part 1 application by Ebox Inc. in which it complains that 9303-4338 Québec Inc. (identified as Oxio in the application), who operates exempt broadcasting distribution undertakings (BDUs) across the province of Quebec, does not meet a number of requirements set out in Revised exemption order for terrestrial broadcasting distribution undertakings serving fewer than 20,000 subscribers^Footnote1 .

On 17 December 2020, Télé Inter-Rives Ltée (Télé Inter-Rives) filed an intervention in relation to the complaint against Oxio. On that same date, Oxio filed its response in which it indicates, among other things, being in talks with Télé Inter-Rives in an effort to offer its local stations.

On 5 February 2021, Commission staff sent requests for additional information to Télé Inter-Rives and Oxio.

On 12 February 2021, both parties filed the additional information as requested. Commission staff has deemed appropriate to add the information on the public file of the proceeding.

In light of this new information being added to the record and in order to have all relevant information on the file, staff has chosen to reopen the proceeding to allow parties to comment on this new information. The scope of any additional comments to be filed by interveners and any reply to be filed by the applicant must be limited strictly to the additional information dated 12 February 2021 filed by Télé Inter-Rives and Oxio. The timelines are set out as follows:
