CJSO-FM Sorel-Tracy – Licence renewal

The Commission renews the broadcasting licence for the French-language commercial radio station CJSO-FM Sorel-Tracy from 1 September 2021 to 31 August 2028.

Application

  1. The Commission has the authority, pursuant to subsection 9(1) of the Broadcasting Act (the Act), to issue and renew licences for such terms not exceeding seven years and subject to such conditions related to the circumstances of the licensee as it deems appropriate for the implementation of the broadcasting policy set out in subsection 3(1) of the Act.
  2. Radio Diffusion Sorel-Tracy inc. filed an application to renew the broadcasting licence for the French-language commercial radio station CJSO-FM Sorel-Tracy, Quebec, which expires 31 August 2021. The Commission did not receive any interventions in regard to this application.

Background

  1. In Broadcasting Decision 2010-857, the Commission granted CJSO-FM a short-term renewal of four years in light of the licensee’s non-compliance in regard to the broadcast of French-language vocal music.
  2. In Broadcasting Decision 2014-271, the Commission granted CJSO-FM a short-term renewal of three years in light of the licensee’s non-compliance in regard to the broadcast of Canadian music selections drawn from content category 3 (Special Interest Music) and of French-language vocal music.
  3. In Broadcasting Decision 2017-294, the Commission granted the station a short-term licence renewal of two years in light of the licensee’s non-compliance in regard to the submission of radio monitoring materials and in regard to participation in the National Public Alerting System.
  4. Finally, in Broadcasting Decision 2019-408, the Commission granted CJSO-FM a short-term licence renewal. The Commission also imposed mandatory orders requiring the licensee to comply at all times with paragraphs 9(3)(a) and 9(3)(b) of the Radio Regulations, 1986, as well as with condition of licence 3 set out in that decision.

Commission’s analysis and decision

  1. The Commission notes the licensee’s history of non-compliance. However, for the current licence term, the licensee has been in compliance with its regulatory obligations.
  2. In light of the licensee’s compliance, and consistent with the Commission’s authority pursuant to subsection 9(1) of the Act, the Commission renews the broadcasting licence for the French-language commercial radio programming undertaking CJSO-FM Sorel-Tracy, Quebec, from 1 September 2021 to 31 August 2028. The terms and conditions of licence are set out in the appendix to this decision.

Reminders

  1. The licensee must pay, no later than 31 August 2021, the balance of tangible benefits due in the seventh and final year of the payment period, that is, $2,366. The amount of the tangible benefits was initially $16,562, to be allocated in equal payments over seven consecutive broadcast years. These tangible benefits were approved in an administrative decision dated 13 May 2015 following the approval of Radio Diffusion Sorel-Tracy inc.’s application to change the effective control and to transfer the shares of CJSO-FM. The licensee must submit, no later than 30 November 2021, proof of this last payment of tangible benefits.
  2. Pursuant to section 22 of the Act, the broadcasting licence renewed in this decision will cease to have any force or effect if the broadcasting certificate issued by the Department of Industry lapses.

Terms, conditions of licence, expectation and encouragement for the French-language commercial radio programming undertaking

Terms

The licence will expire 31 August 2028.

Conditions of licence

  1. The licensee shall adhere to the conditions of licence set out in Conditions of licence for commercial AM and FM radio stations, Broadcasting Regulatory Policy CRTC 2009-62, 11 February 2009, as well as to the conditions set out in the broadcasting licence for the undertaking.

Expectation

The Commission expects the licensee to reflect the cultural diversity of Canada in its programming and employment practices.

Encouragement

In accordance with Implementation of an employment equity policy, Public Notice CRTC 1992-59, 1 September 1992, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
