RE: Part 1 Application – Request for an Order prescribing the role of Bell Canada, including its Bell Aliant division, in the provision of access to poles owned by NB Power

Dear Madam,

The Commission is in receipt of Rogers Communications Canada Inc.’s (RCCI) Part 1 Application, dated 17 July 2020, where RCCI is requesting an Order from the Commission prescribing the role of Bell Canada, including its Bell Aliant division, in the provision of access to poles owned by NB Power.

Commission staff notes that the issue raised by RCCI in its Part 1 Application, namely joint-use pole arrangements between an incumbent local exchange carrier and an electrical utility company, was also raised by RCCI as well as by certain parties as part of their submissions to Telecom Notice of Consultation 2019-406Call for comments regarding potential barriers to the deployment of broadband-capable networks in underserved areas in Canada (“TNC 2019-406”).  Accordingly, the issue of joint-use pole arrangements will likely be amongst those examined by the Commission during the proceeding initiated by TNC 2019-406.

In light of the above, RCCI’s Part 1 Application dated 17 July 2020 is being put on hold.
