RE: Part 1 Application – Urgent Relief for Residential Internet Services in Response to COVID-19 – Withdrawal
Dear Mr. Thompson:
On 16 March 2020, the Commission received an application from Northwestel Inc., filed under Part 1 of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (the Rules of Practice and Procedure), and pursuant to section 25 of the Telecommunications Act. On the same day, the Commission also received Tariff Notice 1074, wherein Northwestel Inc. made its willingness to proceed with the tariff amendments set out in Tariff Notice 1074 conditional on the Commission addressing the issues raised in its Part 1 application.
On 18 March 2020, Commission staff issued a letter requesting that Northwestel Inc. remove its application as a condition of proceeding with the proposed tariff amendments, given the Commission’s intention to address some of the issues raised in the application in an upcoming proceeding. In making its request, the Commission noted the unique challenges of participating in proceedings during the COVID-19 crisis, and that it would be premature to make determinations on the issues raised in the application prior to receiving the submissions of other parties in an upcoming proceeding on those same issues.
By letter dated 20 March 2020, Northwestel proposed to withdraw its application, and noted that it would file a revised version of the application.
In light of the above, Northwestel’s request to withdraw its application is appropriate and the application is considered to be withdrawn.
