RE: Applications to Review and Vary Telecom Order CRTC 2019-288 and Telecom Order CRTC 2019-288-1 – Final rates for aggregated wholesale high-speed access (HSA) service – Extension Request

Dear Madams/Sirs:

The Commission is in receipt of a letter, dated 20 January 2020, from Canadian Network Operators Consortium Inc. (CNOC) requesting an extension to the filing deadline for the submission of interventions for the above note proceeding from 30 January 2019 to 17 February 2020.

In a procedural letter, dated 19 December 2019, Commission staff informed all parties that any interested person may file interventions by 30 January 2019 and that the applicant(s) may file a reply by 10 February 2020.

CNOC submitted that, given the extremely busy regulatory schedule and the breadth of the record of this proceedingFootnote1, a heavy burden has been placed on regulatory resources and an extension is necessary to provide a complete and persuasive intervention.

On 21 January 2020, the Commission received letters from British Columbia Broadband Association, Distributel Communications Limited, Public Interest Advocacy Centre, TekSavvy Solutions Inc, and Vaxination Informatique supporting CNOC’s requested extension, citing similar rationale.

The Commission received letters from Bell Canada, TELUS Communications Inc., and a joint letter from Bragg Communications Incorporated (carrying on business as Eastlink), Cogeco Communications Inc., Rogers Communications Canada Inc., Shaw Cablesystems GP, and Videotron Ltd. stating that they did not oppose CNOC’s extension request.  These parties did, however, request that the Commission grant an extension of an equivalent length to the applicant(s) to file a reply from 10 February 2020 to 13 March 2020 noting that significant industry regulatory resources are allocated to the Commission's review of mobile wireless, whose oral hearing stage will run from 18 February 2020 to 28 February 2020, overlapping the reply period for the R&Vs under CNOC's proposal.

Having regard for the concurrent and future proceedings, that no interested party opposed the extension requests, and that the extension requested is needed to prepare fulsome interventions and replies, Commission staff considers that an extension would be reasonable. 

Accordingly, Commission staff informs all parties regarding the revised process to file interventions and reply comments as follows:

In addition to filing documents with the Commission, parties are asked to serve all other parties with any documents filed in this proceeding.
