I am writing in relation to the undue preference complaint dated 30 October 2019 filed by Québecor Média inc. (Québecor), on behalf of Vidéotron ltée (Vidéotron) against CBC/Société Radio-Canada (SRC) concerning the service ICI TOU.TV EXTRA.
Commission staff notes that Videotron has raised a number of policy matters that would appear to fall outside the scope of an undue preference complaint. For example, Videotron has raised multiple concerns about the financing of SRC and its role in the digital sphere, arguing that SRC is going beyond its mandate as a public broadcaster. CRTC staff is of the view that these broader questions would best be dealt with in the context of the CBC’s renewal proceeding, which was launched on 25 November in Broadcasting Notice of Consultation CRTC 2019-379.
However, Videotron has suggested that there may be a violation of the undue preference and exclusivity provisions in the Digital Media Exemption Order CRTC 2012-409 (DMEO). Therefore, the Commission will continue with an analysis of that matter and that matter alone; specifically, the allegation of non-compliance with sections 3 and 5 of the DMEO.
