TELUS Communications Inc. – Revisions to Interexchange channel rental service

Application

  1. The Commission received an application from TELUS Communications Inc. (TCI), dated 13 December 2019, in which the company proposed to revise item 5.12 – Interexchange channel rental service of its Special Assembly Tariff. Specifically, TCI proposed to extend the availability of the service for an additional five years at the current rate, effective 1 December 2019.
  2. TCI submitted that due to an administrative oversight, the service availability was extended prior to Commission approval; accordingly, TCI requested that the Commission ratify the charging of the rate for the service from 1 December 2019 to the date the changes are approved. 
  3. The Commission received no comments regarding TCI’s application.   
  4. The Commission approved the application on an interim basis in Telecom Order CRTC 2020-3, effective 14 January 2020.

Commission’s analysis and determinations

  1. Pursuant to subsection 25(4) of the Telecommunications Act (the Act), the Commission may ratify the charging of a rate by a Canadian carrier otherwise than in accordance with a tariff approved by the Commission if the Commission is satisfied that the rate was charged because of an error or other circumstance that warrants the ratification.
  2. The Commission is satisfied that TCI charged the rate of $3,200 per month for the Interexchange channel rental service without an approved tariff due to an administrative error. The Commission also notes that the company filed its application shortly after the contract related to the service was renewed.
  3. The Commission therefore considers that the company’s request for ratification is reasonable.
  4. In light of the above, the Commission approves on a final basis TCI’s application, and ratifies the charging of the rate in question, pursuant to subsection 25(4) of the Act, from 1 December 2019 to the date of the interim order.  
  5. The Commission directs TCI to issue revised tariff pages within 10 days of the date of this order.Footnote 1

Policy Directions

  1. In accordance with subparagraph 1(b)(i) of the 2006 Policy Direction,Footnote 2 the Commission considers that its approval of TCI’s application will advance the telecommunications policy objective set out in paragraph 7(f) of the Act.Footnote 3
  2. In accordance with the 2019 Policy Direction,Footnote 4 the Commission considers that this order, which is based on a complete record, can promote competition, affordability, consumer interests, and innovation. Specifically, the Commission’s approval of TCI’s application will promote affordability and consumer interests, since it ensures that the customer will continue to have access to high-quality telecommunications services.
