Re:  Bell Canada – Request for the Commission to review, vary, and rescind and stay on an interim basis certain rulings in Telecom and Broadcasting Decision 2019-218 and Telecom Notice of Consultation 2019-219 

On 21 June 2019, the Commission issued Cloudwifi Inc. – Application to prevent Bell Canada from interfering with customer use of Bell Canada’s inside wire, Telecom and Broadcasting Decision 2019-218 (TBD 2019-218), and Show cause proceeding and call for comments – Applicability of the Commission’s preliminary view set out in Telecom and Broadcasting Decision 2019-218 to all telecommunications service providers, Telecom Notice of Consultation 2019-219 (TNC 2019-219). In TBD 2019-218, the Commission directed, among other things, Bell Canada to file proposed amended tariff pages reflecting the determinations set out in the decision within 30 days of the date of the decision – that is, by 22 July 2019.

On 9 July 2019, the Commission received a Part 1 application from Bell Canada, pursuant to sections 25, 52, and 62 of the Telecommunications Act, Part 1 of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure, and Revised guidelines for review and vary applications, Telecom Information Bulletin 2011-214, requesting orders reviewing, varying and rescinding certain Commission findings and directions in TBD 2019-218 and the matters raised in TNC 2019-219. Bell Canada also requested an interim stay of TNC 2019-219 and TBD 2019-218.

Given the issues raised, the need for sufficient process, and the associated timelines, the Commission, with this letter,

  1. Sets out an expedited process for comments on Bell Canada’s request for interim relief as follows:
    1. Interested persons may file comments by 24 July 2019, and
    2. Bell Canada may file reply comments by 29 July 2019;
  2. Suspends the deadline for Bell Canada to file its proposed tariff pending the outcome of the interim decision; and
  3. Suspends the deadline for interventions in the TNC 2019-219 proceeding pending the outcome of the interim decision.

In the meantime, the intervention and reply timelines associated with the final relief requested in Bell Canada’s Part 1 application remain unchanged.
