RE:   Review of mobile wireless services, Telecom Notice of Consultation 2019-57 – Clarification of procedural request of the Commissioner of Competition

Dear Sir/Madam:

On 24 May 2019, the Commission issued a letter directing various parties to file responses to a series of requests for information (RFIs) from Commission staff, which included amendments proposed by the Commissioner of Competition (the Commissioner).  Parties were told to take note of the Commissioner’s request for disclosure and, in the interest of expediency, to respond to it when designating information as confidential.

Responses to the RFIs have now been received. Most parties did not comment on the matter of disclosure to the Competition Bureau in their RFI responses, while some parties indicated that they had no objection to the disclosure request. Bell Mobility Inc. (Bell Mobility), for its part, objected to the disclosure of information it had designated as confidential in relation to some of its RFI responses on the basis, inter alia, that the information was not specifically requested by the Commissioner.

A number of parties, including Bell Mobility, have also at various points made arguments touching on the adequacy of the established procedures should the Commission disclose confidential information to the Commissioner.  This letter is not directed to this matter.

Paragraph 39(4)(b) of the Telecommunications Act provides that the Commission may disclose to the Commissioner on the Commissioner’s request information relevant to a competition issue being considered by the Commission that was designated as confidential.  In the interest of clarity, and to ensure there is no confusion as the Commission considers the request, Commission staff requests that the Commissioner provide a list of the specific RFI responses that comprise his request for disclosure under section 39(4)(b) of the Telecommunications Act. We ask that this list be provided by 2 July 2019.

Other parties have already been given the opportunity to comment on the Commissioner’s request. However, as there appears to be some disagreement as to which specific RFIs fall under the Commissioner’s disclosure request, parties may file any additional comments they may have by 5 July 2019 bearing directly on any clarification provided by the Commissioner in response to this letter.

Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.
