Amendments to the Simultaneous Programming Service Deletion and Substitution Regulations

The Commission amends the Simultaneous Programming Service Deletion and Substitution Regulations as proposed in Broadcasting Notice of Consultation 2019-186. The amendments, which are set out in the appendix to this regulatory policy, will be published in the Canada Gazette, Part II, and come into force on the date of their registration. The Commission did not receive any comments in response to the notice of consultation.
The amendments give effect to the Commission’s determination set out in Broadcasting Decision 2017-149 to amend the Simultaneous Programming Service Deletion and Substitution Regulations. In particular, the Commission determined that these regulations should be amended to enable Bell Media Inc.’s satellite-to-cable service CTV Two Alberta to request simultaneous substitution in the same manner as CTV Two Atlantic.

Secretary General

(1) The definition Canadian television station in subsection 1(1) of the Simultaneous Programming Service Deletion and Substitution Regulations^{Footnote 1} is replaced by the following:

Canadian television station means a television programming undertaking that is licensed as a television station or that provides its Canadian programming service by way of a transmitting antenna, and includes an educational authority responsible for an educational television programming service and the stations CTV Two Atlantic, and CTV Two Alberta. (2) Paragraph (c) of the definition local television station in subsection 1(1) of the Regulations is replaced by the following:

(c) the station CTV Two Atlantic or CTV Two Alberta. (station de télévision locale)
