Various commercial radio stations – Licence renewals and amendments

The Commission renews the broadcasting licences for the commercial radio stations listed in the decision from 1 September 2019 to 31 August 2026.

The Commission approves Vista Radio Ltd.’s (Vista) applications to amend the broadcasting licences for CFGM-FM Caledon, CKVV-FM Kemptville, CFXN-FM North Bay, CFZN-FM Haliburton and CFIF-FM Iroquois Falls to delete their over-and-above Canadian content development (CCD) conditions of licence.

The Commission approves, in part, Vista’s application to amend the broadcasting licence for CKPP-FM Prescott to delete its over-and-above CCD condition of licence. CKPP-FM will continue to make over-and-above CCD contributions until the end of the 2021-2022 broadcast year.

Vista also filed applications to amend the broadcasting licences for CFGM-FM (2018-0598-8), CKPP-FM (2018-0593-8), CKVV-FM (2018-0596-2), CFXN-FM (2018-0595-4), CFZN-FM (2018-0599-6) and CFIF-FM (2018-0600-4) to delete their over-and-above Canadian content development (CCD) conditions of licence, set out in Various radio programming undertakings – Acquisition of assets, Broadcasting Decision CRTC 2012-577, 19 October 2012.
  3. The Commission did not receive any interventions regarding these applications.

Licence renewals

  1. Given that the stations listed in this decision are in compliance with their regulatory requirements, the Commission finds it appropriate to renew the broadcasting licences for these stations for a full licence term of seven years.

Licence amendments

  1. It is the Commission’s general practice to require that radio stations make over-and-above CCD contributions over seven consecutive broadcast years, upon commencement of operations.
  2. The Commission confirms that CFGM-FM, CKVV-FM, CFXN-FM, CFZN-FM and CFIF-FM have made over-and-above CCD contributions for seven consecutive broadcast years.
  3. Consequently, the Commission finds it appropriate to delete the over-and-above CCD conditions of licence for CFGM-FM, CKVV-FM, CFXN-FM, CFZN-FM and CFIF-FM.
  4. With respect to CKPP-FM, the Commission notes that the station began operating in the 2015-2016 broadcast year. As such, the Commission finds it appropriate to require that the licensee continue to make over-and-above CCD contributions until the end of the 2021-2022 broadcast year.

Conclusion

  1. In light of all of the above, the Commission renews the broadcasting licences for the commercial radio programming undertakings listed in this decision from 1 September 2019 to 31 August 2026. The conditions of licence for these stations are set out in the appendix to this decision.
  2. Further, the Commission approves the applications by Vista Radio Ltd. to amend the broadcasting licences for CFGM-FM Caledon, CKVV-FM Kemptville, CFXN-FM North Bay, CFZN-FM Haliburton and CFIF-FM Iroquois Falls to delete their over-and-above CCD conditions of licence.
  3. Finally, the Commission approves, in part, the application by Vista Radio Ltd. to amend the broadcasting licence for CKPP-FM Prescott to delete its over-and-above CCD condition of licence. CKPP-FM will continue to make over-and-above CCD contributions until the end of the 2021-2022 broadcast year. A condition of licence to that effect is set out in the appendix to this decision.

Reminder

  1. Pursuant to section 22 of the Broadcasting Act, the broadcasting licences renewed in this decision will cease to have any force or effect if the broadcasting certificates issued by the Department of Industry lapse.

Employment equity

  1. Because Vista is subject to the Employment Equity Act and files reports with the Department of Employment and Social Development, its employment equity practices are not examined by the Commission.

Appendix to Broadcasting Decision CRTC 2019-202

Terms, conditions of licence and expectation for the commercial radio programming undertakings renewed in this decision

Terms

The licence will expire 31 August 2026.

Conditions of licence applicable to all stations

  1. The licensee shall adhere to the conditions set out in Conditions of licence for commercial AM and FM radio stations, Broadcasting Regulatory Policy CRTC 2009-62, 11 February 2009, with the exception of condition of licence 8 for CFZN-FM Haliburton and CFSF-FM Sturgeon Falls relating to the solicitation of local advertising, which does not apply to stations operating in a single-station market, as well as to the conditions set out in the broadcasting licence for each undertaking.

Additional condition of licence applicable to CFGM-FM Caledon

  1. The licensee shall, as an exception to the percentage of Canadian musical selections set out in sections 2.2(8) and 2.2(9) of the Radio Regulations, 1986 (the Regulations), in any broadcast week:
    1. devote, in that broadcast week, at least 75% of its musical selections from content category 2 (Popular Music) to Canadian selections broadcast in their entirety; and
    2. devote, between 6 a.m. and 6 p.m., in the period from Monday to Friday of the same broadcast week, at least 75% of its musical selections from content category 2 to Canadian selections broadcast in their entirety.

    For the purposes of this condition, the terms “broadcast week,” “Canadian selection,” “content category” and “musical selection” shall have the same meaning as that set out in the Regulations.

Additional condition of licence applicable to CKVV-FM Kemptville

  1. The licensee shall, as an exception to the percentage of Canadian musical selections set out in sections 2.2(8) and 2.2(9) of the Radio Regulations, 1986 (the Regulations):
    1. devote, in that broadcast week, at least 40% of its musical selections from content category 2 (Popular Music) to Canadian selections broadcast in their entirety; and
    2. devote, between 6 a.m. and 6 p.m., in the period from Monday to Friday of the same broadcast week, at least 40% of its musical selections from content category 2 to Canadian selections broadcast in their entirety.

    For the purposes of this condition, the terms “broadcast week,” “Canadian selection,” “content category” and “musical selection” shall have the same meaning as that set out in the Regulations.

Additional conditions of licence applicable to CKPP-FM Prescott

  1. The licensee shall, as an exception to the percentage of Canadian musical selections set out in sections 2.2(8) and 2.2(9) of the Radio Regulations, 1986 (the Regulations), in any broadcast week:
    1. devote, in that broadcast week, at least 40% of its musical selections from content category 2 (Popular Music) to Canadian selections broadcast in their entirety; and
    2. devote, between 6 a.m. and 6 p.m., in the period from Monday to Friday of the same broadcast week, at least 40% of its musical selections from content category 2 to Canadian selections broadcast in their entirety.

    For the purposes of this condition, the terms “broadcast week,” “Canadian selection,” “content category” and “musical selection” shall have the same meaning as that set out in the Regulations.

  2. In addition to the basic annual contribution to Canadian content development (CCD) set out in section 15 of the Radio Regulations, 1986, the licensee shall make an annual contribution of $5,000 in each of the 2019-2020, 2020-2021 and 2021-2022 broadcast years to the promotion and development of Canadian content.
    Of this amount, the licensee shall allocate no less than 20% per broadcast year to FACTOR or MUSICACTION. The remainder of this additional CCD contribution shall be allocated to parties and initiatives fulfilling the definition of eligible initiatives set out in paragraph 108 of Commercial Radio Policy 2006, Broadcasting Public Notice CRTC 2006-158, 15 December 2006.

Expectation applicable to all stations

The Commission expects the licensee to reflect the cultural diversity of Canada in its programming and employment practices.
