RE:  Part 1 application requesting ratification of Special Services Tariff (SST) rates

Dear Sir:

On 11 May 2018, the Commission received responses to a Request for Information (RFI) from Northwestel pertaining to the Part 1 application noted above.

Paragraph 28(1) (a) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure provides that the Commission may require parties to file information or documents where needed.

Northwestel is requested to provide comprehensive answers, including rationale and any supporting information, to the attached questions by 6 June 2018.

Requests for information

1. Pursuant to subsection 25(4) of the Telecommunications Act (the Act), the Commission may ratify the charging of a rate by a Canadian carrier otherwise than in accordance with a tariff approved by the Commission if it is satisfied that the rate was charged because of an error or other circumstance that warrants the ratification. A ratification request must include all amounts charged where the services or rates were not reflected in an approved tariff at that time.

Under question 1 d) of the RFI that was sent to Northwestel on 20 April 2018, Northwestel was asked to confirm the total amount, including usage and installation charges, for which ratification is requested for each of the nine SSTs.

Commission staff notes that in its response, Northwestel provided details of the monthly rates and dates involved but did not give a total dollar amount for all of the SSTs.

Commission staff also notes that in cases where total amounts were provided for individual SSTs, they differ significantly from the amounts included in the 8 February 2018 Part 1 application, and do not appear to represent the rates charged otherwise than in accordance with an approved tariff.

Northwestel is therefore requested to refile its answers to question 1 d), clearly indicating the period and the total amount for which ratification is requested for each of the nine SSTs.

2. Confirm the total amount for which ratification is requested for the combination of the nine SSTs covered by this Part 1 application.
