Distribution of The Weather Network/MétéoMédia by licensed broadcasting distribution undertakings
Pursuant to section 9(1)(h) of the Broadcasting Act, the Commission orders licensees of broadcasting distribution undertakings to distribute the discretionary service of Pelmorex Weather Networks (Television) Inc. (Pelmorex) known as The Weather Network/MétéoMédia (TWN/MM) as part of the digital basic service on the following terms and conditions:
- This order applies to licensed distribution undertakings, including terrestrial and DTH distribution undertakings. These licensees are collectively referred to in this order as distribution licensees.
- Distribution licensees shall distribute the programming service under the following terms:
- A terrestrial distribution undertaking licensee operating in an anglophone market must distribute either the regional feed of The Weather Network having the greater relevance to its subscribers when it is made available by Pelmorex or, subject to an agreement with Pelmorex, the national feed of The Weather Network, to all digital subscribers as part of the digital basic service.
- A terrestrial distribution undertaking licensee operating in a francophone market must distribute either the regional feed of MétéoMédia having the greater relevance to its subscribers when it is made available by Pelmorex or, subject to an agreement with Pelmorex, the national feed of MétéoMédia, to all digital subscribers as part of the digital basic service.
- A DTH distribution undertaking licensee must distribute, on a national basis, the national feed of The Weather Network to subscribers who subscribe to an English-language or bilingual basic service package.
- A DTH distribution undertaking licensee must distribute, on a national basis, the national feed of MétéoMédia to subscribers who subscribe to a French-language or bilingual basic service package.
- Any distribution licensee is authorized to distribute both the English- and French-language feeds of TWN/MM as part of the entry-level digital basic service offering in every market in Canada.
- Notwithstanding the foregoing, distribution licensees shall not be required to distribute the programming service pursuant to this order unless the licensee or a third party:
- ensures the transmission of the service by any technological means available to the broadcasting distribution undertaking’s head end or to a satellite uplink centre or to another location agreed upon by the broadcasting distribution undertaking and the service;
- bears the costs of the transmission to the connection point.
- Each distribution licensee distributing the programming service shall remit to the licensee of the programming service a wholesale rate of $0.22 per subscriber per month where the service is distributed as part of the basic service.
- This order shall take effect 1 September 2018 and expire 31 August 2023.
For the purposes of this order, “anglophone market,” “basic service,” “DTH distribution undertaking,” “francophone market,” “licensed,” “programming service” and “terrestrial distribution undertaking” shall have the same meanings as those set out in the Broadcasting Distribution Regulations, as amended from time to time.
