Distribution of the programming services of Cable Public Affairs Channel Inc. (CPAC Inc.) known as Cable Public Affairs Channel and of the exempt services operated by CPAC Inc.by licensed broadcasting distribution undertakings

Pursuant to section 9(1)(h) of the Broadcasting Act, the Commission orders licensees of broadcasting distribution undertakings to distribute the licensed public affairs programming services of Cable Public Affairs Channel Inc. (CPAC Inc.) and the exempt services operated by CPAC Inc. pursuant to Amendments to the Parliamentary and Provincial or Territorial Legislature Proceedings Exemption Order – new provision relating to emergencies, Broadcasting Order CRTC 2012-349, 26 June 2012, as amended from time to time (collectively, the CPAC services), under the following terms and conditions:

  1. This order applies to licensed distribution undertakings, including terrestrial and DTH distribution undertakings. The licensees of these undertakings are collectively referred to in this order as distribution licensees.
  2. Distribution licensees shall distribute the CPAC services in the manner specified below:
    1. Subject to subparagraph (iv) and except as otherwise provided under a condition of its licence,
      • each terrestrial distribution undertaking operating in a francophone market shall distribute as part of its basic service the CPAC services, including the main audio channel of those services in the French language and an auxiliary audio channel of those services in the English language.
      • each terrestrial distribution undertaking operating in an anglophone market shall distribute as part of its basic service the CPAC services, including the main audio channel of those services in the English language and an auxiliary audio channel of those services in the French language.
    2. Each terrestrial distribution undertaking operating in a francophone market shall distribute a second version of the CPAC services, including the main audio channel of those services in the English language. This second version may be distributed as part of the basic service or on a discretionary basis.
    3. Each terrestrial distribution undertaking operating in an anglophone market shall distribute a second version of the CPAC services, including the main audio channel of those services in the French language. This second version may be distributed as part of the basic service or on a discretionary basis.
    4. If a terrestrial distribution undertaking elects to distribute as part of its basic service both an English-language and a French-language version of the CPAC services, it is relieved of the requirements in (i) above to distribute an auxiliary audio channel for any of these services.
    5. Except as otherwise provided under a condition of its licence, a DTH distribution undertaking shall distribute as part of its basic service the English- and French-language versions of the CPAC services.
  3. Notwithstanding the foregoing, distribution licensees shall not be required to distribute the CPAC services unless CPAC Inc. or a third party:
    1. ensures the transmission of the services by any technological means available to the broadcasting distribution undertaking’s head end or to a satellite uplink centre or to another location agreed upon by the broadcasting distribution undertaking and the services;
    2. bears the costs of the transmission to the connection point.
  4. Notwithstanding the foregoing, distribution licensees shall not be required to distribute the CPAC services if CPAC Inc. ceases to provide the services exempted pursuant to Amendments to the Parliamentary and Provincial or Territorial Legislature Proceedings Exemption Order – new provision relating to emergencies, Broadcasting Order CRTC 2012-349, 26 June 2012, as amended from time to time.
  5. Each distribution licensee distributing the programming services shall remit to CPAC Inc. a wholesale rate of $0.13 per subscriber per month.
  6. This order shall take effect 1 September 2018 and expire 31 August 2023.

For the purposes of this order, “anglophone market,” “basic service,” “DTH distribution undertaking,” “francophone market,” “licensed,” “programming service” and “terrestrial distribution undertaking” shall have the same meanings as those set out in the Broadcasting Distribution Regulations, as amended from time to time.
