Distribution of Canal M by licensed broadcasting distribution undertakings

Pursuant to section 9(1)(h) of the Broadcasting Act, the Commission orders licensees of broadcasting distribution undertakings to distribute the programming of Canal M on the following terms and conditions, effective 1 September 2018:

  1. This order applies to all licensed distribution undertakings, including terrestrial and DTH distribution undertakings. These licensees are collectively referred to in this order as distribution licensees.
  2. Distribution licensees shall distribute the programming service on the digital basic service in the following manner:
    1. All terrestrial distribution undertaking licensees shall distribute the programming service on an audio channel in francophone markets; and
    2. DTH distribution undertaking licensees shall distribute the programming service on an audio channel to all persons subscribing to any of the undertaking’s French-language digital basic service packages.
  3. Each terrestrial distribution undertaking licensee distributing Canal M in a francophone market shall remit to the licensee of the programming service a monthly wholesale rate of $0.04 per subscriber.
  4. Each licensee of a DTH distribution undertaking shall remit to the licensee of the programming service a monthly wholesale rate of $0.04 for each subscriber who subscribes to a French-language digital basic service package.
  5. This order shall remain in effect until 31 August 2023.

For the purposes of this order, “basic service,” “DTH distribution undertaking,” “francophone market,” “licensed” and “terrestrial distribution undertaking” shall have same the meanings as set out in the Broadcasting Distribution Regulations, as amended from time to time.
