Type B Native FM radio station in Wendake

The Commission approves an application for a broadcasting licence to operate a Type B Native FM radio station in Wendake, Quebec.

Application

  1. Comité de la Radio communautaire Huronne-Wyandot inc. (Comité Radio Huronne-Wyandot) filed an application for a new broadcasting licence to operate a Type B Native FM radio station in Wendake, Quebec. The Commission did not receive any interventions regarding this application.
  2. Comité Radio Huronne-Wyandot is a not-for-profit corporation controlled by its board of directors.
  3. The applicant currently operates the low-power, Native radio station CIHW-FM Wendake. This application was filed pursuant to the Commission’s process for converting low-power radio stations to regular-power radio stations, as set out in Broadcasting Regulatory Policy 2014-554.
  4. The applicant wishes to operate the station as a regular-power station to improve both the signal’s quality and strength to more effectively reach a large share of its target audience.  
  5. The station would operate at 100.3 MHz (channel 262A) with an average effective radiated power (ERP) of 239 watts (maximum ERP of 400 watts with an effective height of antenna above average terrain of 18.9 metres).
  6. During each broadcast week, the station would broadcast 126 hours of programming, of which 30 hours would be spoken word programming and 96 hours would be musical content.
  7. Comité Radio Huronne-Wyandot committed to broadcasting 106 hours of locally-produced French-language programming, and 20 hours of programming in the Montagnais Innu and Atikamekw languages would come from the Société de communication Atikamekw-Montagnais inc. (SOCAM).
  8. Programming in the Montagnais Innu and Atikamekw languages would deal with topics concerning Aboriginal peoples, specifically, their culture, traditions, education, history and other social themes. The rest of the programming would include shows largely devoted to emerging or well-established artists, especially, but not exclusively, from the highly diverse Aboriginal culture. The licensee would interview these artists and broadcast their performances.

Commission’s analysis and decision

  1. The Commission expects the programming of Native radio stations to be specifically oriented to the interests and needs of the Aboriginal audiences that the stations are licensed to serve. These stations have a distinct role in fostering the development of Aboriginal cultures and, where possible, the preservation of ancestral languages.
  2. In this regard, the proposed Native radio station would continue to broadcast SOCAM productions in Aboriginal languages and topics addressed would primarily concern Aboriginal peoples. It would target the native community in Wendake, communities in the Haute-Saint-Charles district and communities in various other districts of Quebec.
  3. The Commission is satisfied that the present application is consistent with the provisions for Type B Native radio stations set out in Public Notice 1990-89. Accordingly, the Commission approves the application by Comité de la Radio communautaire Huronne-Wyandot inc. for a new broadcasting licence to operate a Type B Native radio programming undertaking in Wendake, Quebec. The terms and conditions of licence are set out in the appendix to this decision.
  4. In Broadcasting Decision 2015-260, the Commission determined that the licensee was in non-compliance with section 9(2) of the Radio Regulations, 1986 with respect to CIHW FM’s annual returns for the 2011-2012 and 2012-2013 broadcast years. Consequently, it renewed the station’s broadcasting licence for a shortened term, from 1 September 2015 to 31 August 2021. The Commission finds it appropriate to maintain the current licence term expiry date for the new FM station.

Revocation of licence

  1. Pursuant to sections 9(1)(e) and 24(1) of the Broadcasting Act, the Commission will revoke the current licence for CIHW-FM and issue a new broadcasting licence once the Department of Industry confirms that its technical requirements have been met and after the applicant informs the Commission in writing that it is prepared to commence operations under the new technical parameters.

Terms and conditions of licence for the Type B Native FM radio programming undertaking in Wendake, Quebec

Terms

The licence will expire 31 August 2021.

The station will operate at 100.3 MHz (channel 262A) with an average effective radiated power (ERP) of 239 watts (maximum ERP of 400 watts with an effective height of antenna above average terrain of 18.9 metres).

Pursuant to section 22(1) of the Broadcasting Act, no licence may be issued until the Department of Industry notifies the Commission that its technical requirements have been met and that a broadcasting certificate will be issued.

The licence for this undertaking will be issued once the applicant has informed the Commission in writing that it is prepared to commence operations. The undertaking must be operational at the earliest possible date and in any event no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 17 January 2020. In order to ensure that such a request is processed in a timely manner, it should be submitted in writing at least 60 days before this date.

Conditions of licence

  1. In each broadcast week, the licensee shall devote at least 35% of its musical selections from content category 2 (Popular Music) to Canadian selections broadcast in their entirety.


    For the purposes of this condition of licence, the terms “content category,” “musical selection,” “Canadian selection” and “broadcast week” shall have the same meanings as those set out in the Radio Regulations, 1986.

  2. The licensee shall adhere to the Canadian Association of Broadcasters’ Equitable Portrayal Code, as amended from time to time and approved by the Commission, and to the Broadcast Code for Advertising to Children, as amended from time to time and approved by the Commission.
