RE: Request for Submission of Outstanding Revisions to General Tariff
Dear Sir:
The purpose of this letter is to notify Cochrane Telecom Services (“Cochrane”) of the requirement to file with the Commission the following revisions/information, as they relate to the filing by Cochrane of Tariff Notices (TNs) 70/70A, 71, 74, and 76.
Group A TN 76
Commission staff has reviewed TN 76, and requests that Cochrane submit the following revisions:
- Item 490, Pages 3, 4, 5, and 6: Subsections 5.01, 5.02 and 5.03 must be renumbered, in order to eliminate the double-referencing/non-sequential arrangement of subsections 5.01 and 5.02.
Group B filing
In addition to the above, Commission staff requests that Cochrane submit a Group B tariff notice (TN), consisting of the following revisions, with supporting rationale, relating to Section 100, Section 190, and Section 210 of the company’s General Tariff: In addition to the proposed tariff pages, please file a copy of the current approved tariff pages for these sections.
- Section 100:Primary Exchange (Local) Service
- Combining the Individual line and Rural rate elements, and the combining of the new combined services with the Touch-Tone service rate.
- If any customers were charged these new rates, an application for ratification must be submitted. This would include business customers up to the date of forbearance of business local exchange services set out in Telecom Decision CRTC 2016-209 (Decision 2016-209).
- Removing the Residence – New Amalgamation rate element.
- Section 190:Private Branch Exchange (PBX) Service
- Combining the PBX-Town and PBX-Rural rate elements, and the proposed combining of the new combined services with the Touch-Tone service rate.
- Increasing the rate for the combined PBX-Town and PBX-Rural rate with the Touch-Tone service rate from $41.96 to $42.56 to adjust for the error in TN 70/70A.
- If any customers were charged these new rates, an application for ratification must be submitted. This would include business customers up to the date of forbearance of business local exchange services set out in Decision 2016-209.
- Removing the PBX-Unincorporated rate element.
- Section 210: Centrex Service
- Combining the Centrex Basic and Centrex Basic – Rural (S.H.) rate elements, and combining these rate elements with the Touch-Tone rate.
- Increasing the rate for the combined Centrex Basic – Town & Rural rate with the Touch-Tone service rate from $41.96 to $42.56 to adjust for the error in TN 70/70A.
- If any customers were charged these new rates, an application for ratification must be submitted. This would include business customers up to the date of forbearance of business local exchange services set out in Decision 2016-209.
Forbearance tariff pages
Additionally, Commission staff notes that, as set out in Decision 2016-209, Cochrane obtained forbearance from the regulation of a number of tariffed business local exchange services, effective 31 May 2016. As set out in Decision 2016-209, Cochrane was directed to submit revised tariff pages reflecting forbearance of the applicable tariff items listed in the Appendix to Decision 2016-209. Commission staff has reviewed the final approved pages submitted by Cochrane and notes the following:
- Items 4.03(a) and 4.03(b) appear twice in Section 100, as does the sentence: “Additional lines are subject to the same rate as the first line”. Additionally, no reference marks were utilized to notate the renumbering of subsections within Section 100.
- A final approved page for Section 110 (page 3) was submitted, with Business Systems service charge elements (item 3) removed. Cochrane is reminded that, as set out in Decision 2016-209, the provisions of Section 110 are not eligible for forbearance. Therefore, the previous tariff page is to be refiled. If any customers were charged rates other than the previously approved rates, an application for ratification must be submitted. This would include business customers up to the date of forbearance of business local exchange services set out in Decision 2016-209.
- In Section 190, no reference marks were utilized to notate the renumbering of subsections 5, 6, 7, 8, and 9 to subsections 1, 2, 3, 4, and 5, respectively.
- The final approved pages submitted for Section 210 show forborne tariff items 1 to 4. To accurately reflect forbearance, tariff items 1 to 4 are not to appear on the tariff pages (i.e., the tariff pages must be blank, and state “Reserved for future use”).
- Section 240: A final approved page for Section 240 (page 2), reflecting the forbearance of item 3.01 (specifically, Key Line-Business (1LWC) and Key Line-Business-Rural (SH)(1LWCR)), was not submitted. Note that Dial Intercom Circuit Service was not forborne and the previous tariff item is to be refiled. If any customers were charged rates other than the previously approved rate for Dial Intercom Circuit Service, an application for ratification must be submitted. This would include business customers up to the date of forbearance of business local exchange services set out in Decision 2016-209
- Final approved pages reflecting the forbearance of Section 260 (item 1, 2) and Section 490 (items 6, 8, 9, 10, and 12) were not submitted.
Commission staff requests that Cochrane resubmit final approved pages (under file number 8640-C1-201510826) to correct the above-described issues with the forbearance tariff filings. Commission staff requests that the revised pages be notated (as applicable) utilizing the reference marks set out in subsection 10(1) of the CRTC Tariff Regulations.
Cochrane is requested to file all of the above-noted revisions by 10 November 2017.
