RE: Tariff Notice 13 – Revisions to the Competitive Local Exchange Carrier (CLEC) Tariff
Dear Ms. McMillan:
On 28 November 2016, the Commission received an application from Distributel Communications Limited (“Distributel”) under Tariff Notice 13 (TN 13), in which the company submitted for the Commission’s consideration and approval revisions to its Access Services Tariff (CRTC 21591). In TN 13, Distributel proposes to add to the tariff provisions that incorporate cross-references to the rates associated with services provided in New Brunswick, Newfoundland, Prince Edward Island, and Saskatchewan by incumbent local exchange carriers (ILECs).
Commission staff is requesting Distributel to file an amended Tariff Notice 13/A (TN 13/A), incorporating the following required information and revisions:
- Check Page: Revision Numbers for Page 38 and Page 40: Commission staff notes that the Revision Numbers associated with Page 38 (i.e., “5”) and Page 40 (i.e., “7”) are incorrect. The Check Page must be revised such that the Revision Number associated with Page 38 reads “6”, and the Revision Number associated with Page 40 reads “8”, to correspond to the Revision Numbers listed on the proposed Page 38 and Page 40 filed with the application. Additionally, the Check Page must be revised such that the references to Page 38 and its associated Revision Number appear in red typeface, to correspond to the references to other pages on the Check Page that are proposed to be modified. Commission staff notes that references to Page 38 appear in black typeface on the Check Page submitted with the application.
- Page 45 and Page 52.1: Commission staff notes that, as indicated in red typeface on the Check Page filed with the application, TN 13 includes revisions to Page 45 (listed on the Check Page as Revision Number 8) and to Page 52.1 (listed on the Check Page as Revision Number 4). Commission staff notes, however, that the existing and proposed versions of Page 45 and Page 52.1 were not filed with the application. Both the existing and proposed versions of Page 45 and Page 52.1 must be filed with TN 13/A.
- Proposed Page 46, Item 402.4 – Trunk-side Access (Access Charge): Commission staff notes that Distributel is proposing to revise the Trunk-Side Access Monthly Charge table to add New Brunswick, Newfoundland, Prince Edward Island, and Saskatchewan. Staff notes, however, that MTT CRTC 10001, Item 1270(5)(b)(2) is not the correct tariff cross-reference for New Brunswick, Newfoundland, and Prince Edward Island (the tariff cross-reference is correct for Nova Scotia). The Trunk-Side Access Monthly Charge table must be amended to add the correct tariff item cross-references for New Brunswick (i.e., NBTel CRTC 12001, Item 805.2(B)(2)(b)), Newfoundland (i.e., NewTel CRTC 13001, Item 295(3)(c)), and Prince Edward Island (i.e., IslandTel CRTC 11001, Item 922(2)(a)(1)).
- In accordance with the requirements set out at paragraph 27 of Telecom Information Bulletin 2010-455-1, Distributel must file both the existing tariff pages and the proposed revised tariff pages associated with TN 13 and TN 13/A.
The above-requested information and revisions are required to be filed with the Commission by 24 January 2017.
