Re: Application 2015-0820-2 – Application by OUTtv Network Inc. against Bell Canada alleging an undue preference
Dear Mr. Danks:
This is in reference to the application 2015-0820-2 dated 30 July 2015 by OUTtv Network Inc. (OUTtv) against Bell Canada (Bell) wherein OUTtv claimed it was being subjected to an undue disadvantage contrary to s. 9(1) of the Broadcasting Distribution Regulations.
The file was suspended while the parties attended mediation in an effort to resolve their dispute. The mediation resulted in an agreement in principle. In follow-up discussions with Commission staff, the parties have continually maintained that they are still pursuing their negotiations.
Noting that the file has now been suspended for many months, and that the parties have not requested further assistance from the Commission, staff considers it appropriate to close this file.
OUTtv may contact Commission staff at a later date should they require further Commission assistance or wish to file a new application.
