Penalty: $90,000

Pursuant to section 72.07 of the Telecommunications Act, S.C. 1993, c. 38 (the Act), the undersigned has issued this Notice of Violation finding Green Planet Home Services Inc. to have committed the following violations contrary to the Canadian Radio-television and Telecommunications Commission’s (CRTC’s) Unsolicited Telecommunications Rules (the Rules) made under section 41 of the Act:

On or between 5 Feb 2013 to 8 April 2015, telemarketing telecommunications were made by Green Planet Home Services Inc. resulting in violations of the following Rules: Part II, section 4 for initiating telemarketing telecommunications to consumers whose telephone numbers were registered on the National Do Not Call List (National DNCL); Part II, section 6 of the Rules for initating telemarketing telecommunications during a time when Green Planet Home Services Inc. was not subscribed to the National DNCL; Part III section 2 for initiating telemarketing telecommunications while not being registered with, and having provided information to the National DNCL operator; and Part II, section 23 of the Rules for failing to comply with the permissible calling hours.

Pursuant to section 72.01 of the Act, the undersigned has determined that the total penalty for the violations identified above is $90,000

The penalty of $90,000 must be paid by Green Planet Home Services Inc. to “The Receiver General for Canada” in accordance with subsection 72.09(3) of the Act.
