RE: Application for costs award with respect to the participation of the Canadian Association of the Deaf in Telecom Notice of Consultation 2015-134, Review of basic telecommunications services
Dear Mr. Roots,
On 27 July 2016, the Commission received an application for costs from the Canadian Association of the Deaf (CAD) with respect to its participation in Telecom Notice of Consultation 2015-134, Review of basic telecommunications services (the proceeding).
The purpose of this letter is to request additional information from the CAD regarding its application for costs.
Telecom Information Bulletin 2016-188
Pursuant to section 68 of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (the Rules of Procedure), when assessing costs applications, the Commission considers, among other criteria, whether the applicant had, or was representative of a group or class of subscribers that had, an interest in the outcome of the proceeding.
On 17 May 2016, the Commission issued Telecom Information Bulletin 2016-188, Guidance for costs award applicants regarding representation of a group or a class of subscribers. In this Information Bulletin, the Commission provided guidance on the type of information that will generally assist it in its consideration of the eligibility criterion applicable to costs applicants who submit that they represent a group or a class of subscribers with an interest in the outcome of a proceeding.
The Commission explained that a costs applicant should make submissions that clearly and specifically identify and describe the group or class of subscribers it purports to represent. The submissions in respect of this criterion should also explain the methods by which the costs applicant represents the group or class of subscribers; it should describe how it determined that the positions put forward reflect the interests of the group or class of subscribers it claims to represent.
CAD has indicated that it represents and is composed of Deaf people on a national basis. In light of the general guidance set out within the information bulletin, Commission staff requests that CAD make submissions that clearly explain the methods by which it represents this group or class of subscribers, and how it determined that the positions put forward in the hearing reflect the interests of this group or class.
Filing Information with the Commission
The requested information is to be filed with the Commission by 3 October 2016. Any other party may file a response by 7 October 2016. The CAD may reply to any comments no later than 14 October 2016.
In addition to being filed with the Commission, your response is to be provided to all persons copied within this letter.
A copy of this letter and all related correspondence will be added to the public record of the proceeding.
If you have any questions or concerns, please feel free to contact me at 819-997-4577 or emilia.desomma@crtc.gc.ca, or Alexander Ly at 613-608-8368 or alexander.ly@crtc.gc.ca.
