RE: MTS Inc. Tariff Notice 769 - Asymmetric Digital Subscriber Line (ADSL) Data Access Service

Dear Ms. Langlotz:

On 24 September 2015, the Commission received two applications from MTS Inc. (MTS) under cover of Tariff Notices 768 (TN 768) and 769 (TN 769), in which the company proposed changes to implement the Commission’s determinations made in Review of wholesale wireline services and associated policies, Telecom Regulatory Policy CRTC 2015-326, 22 July 2015.

On 12 January 2016, the Commission received MTS’s third amendment to its TN 768 (TN 768C), in which the company indicated that it was including within TN 768C the changes it had proposed in TN 769.

In Telecom Order 2016-319 published today, the Commission approved MTS’s application filed under cover of TNs 768, 768A, 768B and 768C.

In light of the inclusion, within TN 768C, of the tariff changes that had been proposed in TN 769 and the Commission’s determination in Telecom Order 2016-319, Commission staff notes that the disposition of TN 769 becomes moot. In light of this, the file associated with TN 769 is closed.
