RE: Eastlink TPIA Tariff Notice 35/35A – Process Letter

Dear Ms. MacDonald,

The Commission is in receipt of the following correspondence:

Commission staff is of the view that further clarification of Eastlink’s reply comments is necessary. Accordingly, Eastlink is to provide a list of the customers, if any, that are telecommunications service providers and that are co-located at Eastlink’s facility at the Pennant Point location or at any downtown Halifax Eastlink location. In addition, Eastlink is to identify which services it provides to these customers. The requested information is to be filed by 9 February 2016.

It has been recently brought to our attention that comments filed by ISN on 21 October 2015 were inadvertently omitted by the Commission from the public record. To ensure a fair and a transparent process, it is important that all comments filed in this proceeding be taken into consideration. Accordingly, ISN’s comments have been properly added to the public record and are now available to view through the Commission’s website. Please note that the date of ISN comment letter is 9 September 2015 instead of 21 October 2015 due to a typographical error.

Commission staff has also received a request by CNOC to extend the period for its review of Eastlink’s TPIA service agreement filed on 14 January 2016. CNOC indicated that it preferred to file comments on the service agreement at the same time as it files its comments on TN35A. Commission staff considers that this request is reasonable.

Accordingly, parties may file interventions regarding TN35A, the TPIA service agreement and the information that Eastlink is to provide by 9 February 2016, with the Commission and serve copies on all other parties by 15 February 2016.

Eastlink may file reply comments regarding the above-noted interventions, as well as regarding ISN’s comments of 21 October 2015 with the Commission, and serve copies on all other parties by 22 February 2016.
