Re: Le son du 49e – Broadcasting Decision CRTC 2016-33 and conditions of approval relating to the ownership of the community FM radio station in Lebel-sur-Quévillon - Application: 2015-0383-9
Dear Mr. Simard:
Further to Broadcasting Decision CRTC 2016-33 (Decision 2016-33), whereby the Commission approved an application by Le son du 49e for authority to operate a low-power, French-language community FM radio programming undertaking in Lebel-sur-Quévillon, Quebec.
In this decision, the Commission stated that no broadcasting licence would be issued until the following information and documents had been filed and deemed acceptable by the Commission. Le son du 49e was required to file this information and documents with the Commission no later than 27 July 2016.
- Le son du 49e’s amended by-laws, which must be compliant with the Direction to the CRTC (Ineligibility to Hold Broadcasting Licences) (the Direction) and confirm the station’s independence from the town of Lebel-sur-Quévillon;
- an updated list of the members of the board of directors and executive staff; and
- any agreement or arrangement between Le son du 49e and the town of Lebel-sur-Quévillon.
On 20th of May and 12th of July 2016, Le son du 49e filed the following documents and information with the Commission:
- new by-laws for Le son du 49e, that were modified bringing it into compliance with the Direction and ensuring the station’s independence from the town of Lebel-sur-Quévillon;
- updated list of the members of the board of directors and executive staff as of 17 May 2016; and
- copy of agreement resolutions between the town of Lebel-sur-Quévillon et Le son du 49e relating to office and tower leases as well as repayment terms relating to costs incurred by the town on behalf of Le son du 49e’s in the preparation and submission of the application to the CRTC.
After reviewing these documents and information, the Commission has determined that the Le son du 49e has satisfied the conditions of approval set out above.
A broadcasting licence expiry date of 31 August 2022 will also be added to the licencing terms set out in Decision 2016-33.
A copy of this letter will be placed on the public record and available for viewing on the Commission website and at its offices.
