Penalty: $25,000

Pursuant to section 72.07 of the Telecommunications Act, S.C. 1993, c. 38 (the Act), the undersigned has issued this Notice of Violation finding AcademyOne Learning Ltd. to have committed the following violations contrary to the Canadian Radio-television and Telecommunications Commission’s (CRTC’s) Unsolicited Telecommunications Rules (the Rules) made under section 41 of the Act:

On or between 25 February 2013 and 22 September 2014, voice telemarketing telecommunications were made by AcademyOne Learning Ltd. resulting in violations of the following Rules: Part II, section 4 for initiating telemarketing telecommunications to consumers whose telephone numbers were registered on the National Do Not Call List (DNCL); Part II, section 6 of the Rules for initating telemarketing telecommunications during a time when AcademyOne Learning Ltd. was not subscribed to the National Do Not Call List; Part II, section 13 for using a version of the Naitonal DNCL that was older than 31 days; and Part III section 23 of the Rules for failing to comply with the permissible calling hours.

Pursuant to section 72.01 of the Act, the undersigned has determined that the total penalty for the violations identified above is $25,000.

The penalty of $25,000 must be paid by AcademyOne Learning Ltd. to “The Receiver General for Canada” in accordance with subsection 72.09(3) of the Act.
