RE:  MTS Inc. Tariff Notice 0772 – Terms of Service

Dear Madam:

On 13 November 2015, the Commission received an application by MTS Inc. (MTS), under Tariff Notice 772 (TN 772), in which the company proposed revisions to its General Tariff Item 200 – Terms of Service.

Paragraph 28(1)(a) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure provides that the Commission may request parties to file information or documents where needed.

MTS is requested to provide comprehensive answers, including rationale and any supporting information, to the attached questions by 16 December 2015.

MTS Tariff Notice 772

Questions

In its application, MTS stated that its proposal is similar to tariff changes sought by TELUS Communications Company (TCC) in TN 637/4349 dated 11 August 2011, and approved on a final basis in Telecom Order 2011-575.

In TN 637/4349, TCC had requested to revise its TCI General Tariff, Item 425 – Local Business Contract Option, and its TCBC General Tariff, Item 32 – Exchange Rates, to introduce, for certain contracted business local exchange services, a new termination charge which it could reduce or waive at its discretion. TCC had argued that the Commission had, in Telecom Decision 2007-106, removed the prohibition on further rate de-averaging for these services.

MTS is now proposing to revise its General Tariff, Item 200 - Terms of Service to allow it to reduce or waive, at its discretion, any applicable termination charges for contracted services that are terminated prior to the expiration of the minimum contract period during a renewal term. Section 1.1 of MTS’ Terms of Service states that the Terms of Service apply with regard to all services for which the CRTC has approved a tariff, unless otherwise specified in the tariff.

  1. Confirm whether the Commission has removed the prohibition on further rate de-averaging for all tariffed services covered by MTS’ Terms of Service.
    1. If yes, for each service, identify the applicable Commission Decision, Regulatory Policy, or Order.
    2. If no, explain with rationale, why the Commission should approve this application, especially with regards to services for which the prohibition on rate de-averaging has not been removed.
