RE:  Tariff Notice 4381 – Radiotelephone Services

On 7 August 2015, the Commission received an application by TELUS Communications Company (TCC), under Tariff Notice 4381 (TN 4381), in which the company proposed to withdraw General Tariff items related to Radiotelephone Services.

Staff notes that TCC informed most of its affected customers via letter dated 7 August 2015 that they could forward comments to the Commission by 15 October 2015, which is 47 business days from the filing date of the application. TCC stated this would allow affected customers who visit their premises on a seasonal basis ample time to provide comments. In conjunction with its response to a request for information, in a letter dated 31 August 2015, TCC informed an additional group of 11 business customers of the same deadline for comments, which is 31 business days from 31 August.

Staff notes that pursuant to Telecom Information Bulletin 2010-455, interested parties are normally allowed to file interventions regarding withdrawal applications within 30 business days of the filing date of the application, and the applicant may file reply comments within 10 business days of the deadline for filing interventions.
However, in consideration of TCC’s notifications to its customers, staff considers it reasonable under the circumstances that the deadline for interventions in relation to this file be 15 October 2015.

Accordingly, staff considers that TCC may file reply comments by 29 October 2015.

Consequently, this application, along with any associated subsequent revisions, will not be disposed of on the 45th business day following receipt. The Commission intends to dispose of this application, along with any associated subsequent revisions, by the end of November 2015.
