RE: Eastlink TPIA Tariff Notice 7 and Tariff Notice 35 – Process Letter
Dear Madams/Sirs:
The Commission is in receipt of three tariff notice applications and two withdrawal requests, dated 4 September 2015 and 15 September 2015, from Persona Communications Inc. (Persona) and Bragg Communications Inc., (Bragg) both operating as Eastlink. These applications and withdrawals were filed, at the request of Commission staff, to correctly reflect the services offered by Persona and Bragg, both operating as Eastlink.
- On 4 September 2015, pursuant to Commission staff instructions, Persona and Bragg both operating as Eastlink filed:
- Tariff Notice (TN) 1, Eastlink’s Third Party Internet Service (TPIA) service which is identical to the application filed under Eastlink (Bragg-Persona) TN 6, dated 26 June 2015, with one exception. Specifically, TN 6 included a request to grandfather the legacy TPIA services in Persona’s Ontario operating locations, which is not included in TN 1. TN 1 includes the new higher TPIA speeds offered in all Eastlink serving areas in Ontario and some maritime provinces.
- A withdrawal request for Eastlink (Bragg-Persona) TN 6.
- TN 7, which proposed to grandfather Eastlink’s (Persona) legacy TPIA services in its Ontario operating locations.
- On 15 September 2015, pursuant to Commission staff instructions, Bragg operating as Eastlink filed Eastlink (Bragg) TN 35. This TPIA service tariff is identical to the application filed under Eastlink TN 1. The numbering of the TN and the service provider had to be altered for administrative purposes.
- Concurrent with the filing of TN 35, Eastlink requested for the withdrawal of TN 1.
Commission staff is of the view that Eastlink (Bragg) TN 35 and Eastlink (Persona) TN 7 are the only remaining valid tariff notices. Interested parties have had an opportunity to comment on the content of the original Eastlink (Bragg-Persona) TN 6 TPIA application. Commission staff notes that TN 35 is identical to Eastlink (Bragg-Persona) TN 6 except for the grandfathering of legacy TPIA services provided by Persona in Ontario. The grandfathering of these services is now addressed in Eastlink (Persona) TN 7.
Commission staff notes that the comments received in the context of Eastlink (Bragg-Persona) TN 6 are relevant to Eastlink (Bragg) TN 35. Accordingly, these comments will form part of the record for Eastlink (Bragg) TN 35.
Commission staff further notes that no comments were received in the context of Eastlink (Bragg-Persona) TN 6 that would be relevant to the disposition of Eastlink (Persona) TN 7. Accordingly, only the substance of Eastlink (Persona) TN 7, namely the grandfathering of legacy TPIA services in Persona’s Ontario territories, are now open to comment.
Consequently, as specified above, parties may file comments on the substance of Eastlink (Persona) TN 7 by no later than 24 September 2015. Reply comments from Eastlink may be filed by no later than 28 September 2015.
