Re: Interrogatories and procedural determinations with respect to a Part 1 application from Shaw Cablesystems G.P. for non-discriminatory and timely access to Concord Pacific Multi-Dwelling Unit Projects
Dear Sirs,
On 30 July 2015, Shaw Cablesystems G.P. (Shaw) filed the above-referenced application with the Commission.
In a letter dated 7 August 2015, Commission staff required Concord Pacific Developments Inc. (Concord) to provide comprehensive answers, including any supporting information, to interrogatories provided in that letter by 10 August 2015. Commission staff also required Concord to identify the service provider(s) that have been provided pre-construction access to the three multi-dwelling unit (MDU) projects that are the subject of the application (the identified service provider(s)), and notified Shaw that it must serve the identified service provider(s) with a copy of its 30 July 2015 application by 12 August 2015.
In a letter dated 10 August 2015, Novus Entertainment Inc. (Novus) advised that Concord would be unable to meet the deadline for interrogatories, and requested an extension of one week’s time to 17 August 2015.
In a letter dated 11 August 2015, Shaw requested that the Commission require Concord to provide, at a minimum, the identified service provider(s) by 12 August 2015.
Commission staff hereby revises the deadlines provided in its 7 August 2015 letter as follows:
Concord’s responses to Commission staff’s interrogatories in the Commission’s 7 August 2015 letter are to be filed with the Commission, and served on Shaw, by 17 August 2015.
To the extent that Concord is able to identify the service provider(s) prior to 17 August 2015, Concord is to provide such information, serving a copy on Shaw, as soon as possible, and, in any event, no later than 17 August 2015.
Upon receiving the information regarding the identity of the service provider(s), Shaw is to serve the identified service provider(s) with a copy of its 30 July 2015 application within two business days, or by no later than 19 August 2015.
