RE: City of Calgary request regarding as-built drawings for 2014

On 25 May 2015, Commission staff issued a letter in which it closed an application by Bell Canada, MTS Inc., Allstream Inc., Rogers Communication Partnership, Shaw Cablesystems G.P. (Shaw) and TELUS Communications Company (TCC) (collectively, the Carriers) based on the understanding that the parties had expressed a commitment to resolve outstanding issues related to terms in their expired Municipal Access Agreements.

By letter to the Commission dated 31 July 2015, the City of Calgary (the City) requested Commission direction with regard to the provision of as-built drawings of the Carriers’ installations completed during the course of 2014 (the as-built drawings). The City stated that in a report to the Commission dated 8 April 2015, the Carriers agreed to, among other things, provide the as-built drawings to the City by no later than 15 July 2015.

The City stated that as of the date of its letter, Bell Canada, Shaw and TCC had not submitted the as-built drawings by the previously agreed-upon date of 15 July 2015, and requested that the Commission direct the Carriers to submit the as-built drawings forthwith.

By letter dated 10 August 2015, the Carriers stated that due to the confidential nature of the individual Carriers’ as-built drawings, each named Carrier may respond in separate letters to the specific number of outstanding as-built drawings alleged by the City. They stated however that the City vastly over-stated in its letter the number of as-built drawings that are outstanding, and submitted that three carriers had no outstanding as-built submissions, another had one outstanding and a fifth carrier had been in regular contact with the City as it had progressed on submitting its as-built drawings.

Each Carrier may file a response to the City’s request that the Commission direct the Carriers to submit the outstanding as-built drawings, by 21 August 2015, serving a copy on all parties listed in the Distribution List.

The City may file a reply by 26 August 2015, serving a copy on all parties listed in the Distribution List.
