RE:  Bell Aliant Tariff Notice 518 and Bell Canada Tariff Notice 7459 – Withdrawal of Services

Dear Mr. Gauvin:
On 5 June 2015, the Commission received an application from Bell Aliant Regional Communications, Limited Partnership (Bell Aliant) under cover of Tariff Notice (TN) 518 and Bell Canada under cover of TN 7459, in which the companies proposed to withdraw the following items from their respective Access Services Tariffs: Item 40.2 – National Origination and Item 75 – Dialed Number Transport Capability.

Commission staff notes that the Dialed Number Transport Capability was a wholesale service assigned to the Interconnection service category in Telecom Decision CRTC 2008-17, and that no changes were made to its regulatory status in Telecom Regulatory Policy CRTC 2015-326. Commission staff notes that the National Origination service was not assigned to any service category in Telecom Decision CRTC 2008-17.

Commission staff is seeking supporting information from Bell Aliant and Bell Canada in the above-noted TN 518 and TN 7459 proceeding with respect to Item 75 – Dialed Number Transport Capability and is setting out additional process related to the application.

Bell Aliant and Bell Canada are to provide their response to the attached request for information by 21 August 2015.  The response must be received, not merely sent, by that date.

Appendix 1 -- Request for Information

In TN 518 and TN 7459 Bell Aliant and Bell Canada sought, in part, approval from the Commission to withdraw Item 75 - Dialed Number Transport Capability from their respective Access Services Tariffs. Bell Aliant and Bell Canada submitted that there are currently no customers utilizing the service and that there have not been any customers since 2007. To support the Commission in its analysis, apply the essentiality test outlined in paragraphs 31 to 46 of Telecom Regulatory Policy 2015-326 to Item 75 – Dialed Number Transport Capability and explain with supporting rationale how it does or does not meet the essentiality test components, which are listed below:     

  1. The facility is required as an input by competitors to provide telecommunications services in a relevant downstream market (the input component);
  2. The facility is controlled by a firm that possesses upstream market power such that denying (or withdrawing) access to the facility would likely result in a substantial lessening or prevention of competition in the relevant downstream market (the competition component); and
  3. It is not practical or feasible for competitors to duplicate the functionality of the facility (the duplicability component).
