RE: Saskatchewan Telecommunications General Tariff item 110.16, Direct Customer Access and Wiretap Services

Dear Sir:

In the course of its ongoing review of tariffs on file, Commission staff has identified that Saskatchewan Telecommunications (SaskTel) General Tariff item 110.16, Customer Information Requests and Wiretap Services, does not conform to the Commission’s policy regarding the provision of confidential customer information and wiretap services to law enforcement agencies (LEAs). Commission staff notes that the Commission found in Telecom Order 2000-676 that such LEA services that are mandated by court orders are not telecommunications services within the meaning of the Telecommunications Act (the Act).

Commission staff requests that SaskTel file a Tariff Notice, by 15 May 2015, withdrawing those aspects of General Tariff Item 110.16 that the Commission has previously determined do not involve telecommunications services as defined under theAct.
