Re: Shaw Cablesystems G.P. Tariff Notice 22 TPIA rate increases and speed changes – Cost application – Participation of CAC-PIAC

Dear Mr. Lawford:

On 13 March 2015 the Public Interest Advocacy Centre (PIAC), as counsel for the Consumers’ Association of Canada (CAC) (together CAC-PIAC) applied for costs with respect to its participation in the proceeding initiated by Shaw Cablesystems G.P. Tariff Notice 22 (TN 22).

The purpose of this letter is to inform you that Commission staff is returning CAC-PIAC’s costs application.

The Commission made an interim determination with respect to TN 22 prior to the receipt of your submissions and therefore did not consider them in coming to that determination, as set out in Telecom Order 2015-73.Footnote 1 As indicated at paragraph 5 of that order, the Commission intends to take CAC-PIAC’s intervention into account as part of the proceeding when disposing of Shaw’s application on a final basis. Moreover, final disposition of Tariff Notice 22 may require further process.

Given the above, Commission staff considers that PIAC’s application for costs, as filed, is premature. A copy of this letter and all related correspondence will be added to the public record of the proceeding.
