Re: Staff opinion on matters related to inter-carrier porting

Dear Mr. Unrau,

This is in response to a letter dated 11 March 2015 from Teliphone Navigata-Westel Communications Inc. (TNW) requesting a Commission staff opinion on matters related to inter-carrier porting. On 18 March 2015, Comwave filed with the Commission a response to the above-referenced request.

Commission staff notes that a dispute between TNW and Comwave concerning these issues is currently before the Ontario Superior Court of Justice. Commission staff considers that it would not be appropriate at this time to address matters concerning the contractual dispute that are currently before the Court, and not the Commission.

Commission staff does note, however, that the following documents and decisions should be considered when a telecommunications service provider is involved in customer migration:

Staff also notes that in Telecom Decision CRTC 2010-511, which relates to a dispute involving bulk porting of telephone numbers between local service providers, the Commission stated the following:

14.  The Commission notes that Comwave and Cybersurf entered into a commercial agreement that included, among other things, a clause regarding an administration fee for transferring telephone numbers assigned by Comwave to another company. The Commission notes that, as a reseller, Comwave is not required to file tariffs for Commission approval and can charge market rates for its services. [...]
