RE: Telecom Order CRTC 2015-73; Shaw Cablesystems G.P. – Introduction of five new third-party Internet access service speeds – Procedure for Request to Issue Correction
Dear Mr. Cowling:
The Commission is in receipt of a letter dated 4 March 2015, in which Shaw Cablesystems G.P. (Shaw) requested that the Commission issue a correction to Telecom Order CRTC 2015-73 (Order 2015-73) by changing the interim rate for Shaw’s TPIA Internet 30 service offering from $22.45 to $29.83. Shaw proposed that the Commission do so on an urgent basis by issuing a “correction to Order 2015-73 on an administrative basis”.
If Shaw wishes to make submissions to the Commission on the issue of whether the Commission should review, rescind or vary Order 2015-73, it must do so in the context of an application filed pursuant to section 62 of the Telecommunications Act (a review and vary application).
The Commission’s Revised guidelines for review and vary applications can be found in Telecom Information Bulletin 2011-214. In that Information Bulletin, the Commission outlines the criteria it uses to assess review and vary applications.
In order to ensure that a review of Order 2015-73 can be conducted in an expeditious manner, the following procedure will be put in place if Shaw files a review and vary application with the Commission, serving copies on all interested parties, by 23 March 2015 (10 business days of the date of this letter):
- Parties may file written comments with the Commission, solely in relation to Shaw’s review and vary application by 30 March 2015 (five business days), serving copies on all parties.
- Shaw may file reply comments with the Commission by 2 April 2015 (three business days) serving copies on all parties.
