RE: Part 1 Application - Request for Commission direction to utilize the Model Municipal Access Agreement as basis for negotiations

On 2 February 2015, the Commission received an application from Bell Canada, MTS Inc. and Allstream Inc. (collectively MTS Allstream), Rogers Communications Partnership, Shaw Cablesystems G.P. and TELUS Communications Company (collectively, the Carriers), requesting, amongst other things, that the Commission direct the City of Calgary (City) to recommence negotiations of a municipal access agreement with the Carriers utilizing the Model Municipal Access AgreementFootnote 1 as the basis for negotiations.

By letter dated 10 February 2015, the City advised the Commission that it had not been served with the application and that City staff members noticed the application while viewing the Commission’s website.

By letter dated 11 February 2015, the Carriers stated that upon receipt of the City’s letter dated 10 February 2015, they sent an email to the City explaining that as a result of an inadvertent oversight, the City had not been served with the Carriers’ application. The Carriers added that they would forward another non-redacted and abridged copy of their application to the City, and that they were not opposed to extending the deadline for the filing of an answer.

Commission staff notes that on 11 February 2015, the City was served with a non-redacted version and an abridged copy of the Carriers’ application in accordance with subsection 18(c) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure.

In view of the circumstances, the deadline to file an answer or an intervention in this proceeding is extended to 13 March 2015. The Carriers may file a reply by 23 March 2015, serving a copy on the City and any intervener.

Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.
