Re: Shaw Communications Inc. Tariff Notice 22 – Request for extension
Dear Sir,
The Commission is in receipt of the following correspondence:
- a letter, dated 28 January 2015, from Juce Communications Inc. (Juce), in which Juce made corrections to comments it had submitted on 19 January 2015;
- a letter, dated 4 February 2015, from Shaw Communications Inc. (Shaw), in which Shaw requested an extension to the current due date of 9 February 2015 for the filing of their response to the Commission’s request for information dated 3 February 2015. Shaw proposed that they provide responses to Commission interrogatories on 19 February 2015 and that the comments and reply comments dates be modified to 2 March and 9 March 2015, respectively;
- a letter, dated 5 February 2015, from Canadian Network Operators Consortium Inc. (CNOC), in which CNOC requested the filing of additional information and additional disclosure by Shaw in relation to TN 22 and the opportunity for comment and reply on such information and disclosure;
- a letter, dated 6 February 2015, from Shaw, in which Shaw noted CNOC’s comments and submitted that it would “endeavour to provide the assumptions and methodologies used in support of TN 22” while adhering to the guidelines established in Confidentiality of Information used to establish wholesale service rates – Telecom Regulatory Policy CRTC 2012-592, dated 26 October 2012 (TRP 2012-592).
Commission staff is of the view that, while the process associated with staff’s current request for information is ongoing, it would be premature to consider CNOC’s requests for additional information and disclosure. If, after this interrogatory process is complete, any parties wish to make further procedural requests, they may do so in accordance with the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure, SOR/210-277.
Commission staff considers that, under the circumstances, it is appropriate to extend the period for Shaw to file reply comments on Juce’s corrected comments and to file responses to the Commission’s request for information. Accordingly, Shaw is to provide responses to the Commission’s request for information and reply comments on Juce’s intervention, serving copies on all parties, by 19 February 2015.
Commission staff also considers that it is appropriate to extend the period for comment and reply in relation to the Commission’s request for information. Parties may file written comments with the Commission solely in relation to Shaw’s responses to the interrogatories serving copies on all parties, by 11 March 2015. Shaw may file reply comments with the Commission, serving copies on all parties, by 23 March 2015.
Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.
