Re: Final Offer Arbitration between Quebecor Media Inc., on behalf of Videotron G.P. (Videotron), and Telelatino Network Inc. (TLN)

This letter is to advise the parties that the request by both parties to modify the scope in the above-noted proceeding has been accepted.

Accordingly, the Commission modifies the scope of this proceeding established in the Commission’s 18 December 2014 letter (the “conduct letter”). Moreover, the Commission sets out revised dates upon which the final offer arbitration is to be conducted. For all other matters with respect to the conduct of this proceeding, please refer to the conduct letter.

The Request

In a letter dated 29 January 2015, Videotron and TLN jointly requested a modification to the scope of the final offer arbitration. More specifically, the parties requested that the wholesale rate for TLN when it is offered on a build-your-own-package basis be added to the scope of the proceeding. The parties noted that the build-your-own-package rate is of critical importance to their distribution agreement, noting that it represents, for Videotron, approximately half of all TLN subscribers.

The Determination

In its conduct letter, the Commission specified that it would make a determination only on the following matters:

It noted that it expected parties to continue to negotiate the other rate elements to their affiliation agreement, but that such other elements would not be decided by the Commission in this proceeding.

Since the parties have now agreed to include the build-your-own-package rate within the scope of this proceeding, and noting the particular importance of this matter to the parties, the Commission grants the parties’ request for modification.

Therefore, in this proceeding, the Commission will make a determination concerning the following matters:

As set out in the conduct letter, the final offers will be examined by Commission staff to ensure they respond to the matters identified by the Commission as forming part of the scope.

The following dates shall replace those specified in the conduct letter:

The Commission changes the dates for mediation set out in the conduct letter, to the week of 9 to 13 March 2015.
