Re: Request for clarity regarding procedure - Broadcasting Notice of Consultation CRTC 2015-421

The Commission is in receipt of a letter dated 2 October 2015 from the Syndicat canadien de la fonction publique (SCFP) expressing concern about the procedure related to the Commission’s review of Local and Community Programming outlined in Broadcasting Notice of Consultation 2015-421 (BNC 2015-421).  Specifically, the SCFP notes that while the Commission has announced that it would publish an additional document to focus the discussions at the hearing, which is currently set to commence on 25 January 2016, the Commission did not, in SCFP’s view, provide sufficient clarity with respect to the process under which it and other interested parties could file information in response to the additional document in question.  Specifically, the SCFP seeks to know when the Commission will publish the additional document in question, whether this additional document will form a part of the record of the proceeding announced in BNC 2015-421, and whether interveners will be given the opportunity to file additional comments related to this document.

As indicated in BNC 2015-421-1 released on 20 October 2015, the intervention deadline is now 5 November 2015.  However, the Commission has also indicated that there exist avenues for additional comment that may be made available throughout the process.  One of these avenues will be in response to the additional document noted in the SCFP’s procedural request.  The release of this additional document will be announced at a later date and this document will form a part of the public record of these proceedings.  The Commission expects that this document will aid parties in preparing for the oral phase of the hearing announced in BNC 2015-421.  Interveners, if they wish to add additional information to the public record, may request the ability to do so on or before the date of the hearing.  As indicated in BNC 2015-421, the Commission will decide at a later date whether an additional reply period will be given to interveners.
