Dear Mr. Nadarajah,
This letter is in reference to a procedural request dated 7 October 2015 that you submitted to the Commission on behalf of 8041393 Canada Inc. (East FM) in the context of a Broadcasting Procedural Letter addressed to Peter Miller (105.9 FM Ltd.) dated 30 September 2015. This follows the procedural request submitted by 105.9 FM Ltd. (the applicant) to amend the technical parameters of its application to change the frequency and authorized contours of the low-power, ethnic radio programming undertaking CJVF-FM Scarborough.
Commission staff notes that the revised documents submitted in the applicant’s procedural request have been placed onto the public record for the proceeding of this application (2014-1332-7).
In your procedural request, you have asked for additional time to evaluate the amended technical parameters submitted by the applicant. More specifically, you have requested a 30-day intervention period to submit your intervention, noting that the current deadline of 14 October 2015 would not provide a reasonable amount of time to study the revised documents.
Your procedural request notes that the proposed changes could have a negative impact on East FM’s new FM radio station to serve Scarborough, approved in Broadcasting Decision CRTC 2014-574.
Commission staff recognizes that the need to provide all parties with an opportunity to comment on the additional information that has been added to the public record of this proceeding must be balanced against the need to dispose of the application in the most expeditious manner possible in the circumstances. Accordingly the timelines for comment on the additional information will be amended, as explained in greater detail below.
