Re: Procedural request dated 1 September 2015 – shomi compliance with Telecommunications Act and with Digital Media Exemption Order
The Commission is in receipt of a letter dated 1 September 2015, wherein the Public Interest Advocacy Centre (PIAC) indicated that it became aware, by way of a tweet published by Commissioner Shoan, of a meeting that took place between Commissioner Shoan and the Senior Vice-President and General Manager of shomi. PIAC expressed concern that the meeting took place while the Commission is considering a Part 1 application by PIAC regarding shomi’s regulatory compliance.
In order to avoid any appearance of bias, PIAC requested the Commission to confirm the following:
- Whether or not any other Commissioner or Commission staff were present during the lunch in question; and
- That no Commissioner that attended the meeting would form part of the panel deciding on PIAC’s application.
We can confirm that no other Commissioner was present at the meeting in question and that the PIAC application will be considered and decided by the following three panel members:
- Tom Pentefountas, Vice-Chairman, Broadcasting
- Peter Menzies, Vice-Chairman, Telecommunications
- Yves Dupras, Commissioner, Quebec
