Re:  Procedural request regarding a Part 1 application (2015-0576-0) by Unifor Local 723M (Unifor) for an expedited public hearing regarding the cancellation of original local third-language television newscasts by Rogers Broadcasting Limited (Rogers) on its OMNI stations, and a mandatory order requiring their reinstatement

Dear Mr. Contarin:

This letter is in response to Unifor’s procedural request dated 11 June 2015 requesting that the Commission amend its current procedures regarding the manner in which the above noted application is being processed.  More specifically, Unifor requested that the Commission amend this Part 1 application process by issuing a notice of consultation to call Rogers to an expedited public hearing in order to enable the Commission to determine whether it should issue a mandatory order for Rogers to reinstate original local third-language newscasts on its five OMNI over-the-air television stations.   

By majority decision, the Commission denies Unifor’s request and notes that the substantive relief requested by Unifor in its procedural request is the same as in its Part 1 application, i.e., that the Commission hold an expedited public hearing, following which a mandatory order would be imposed on Rogers.  Consequently, the Commission will continue the processing of this file as a Part 1 application.    

It should be noted that the Commission’s decision to deny Unifor’s procedural request does not reflect a predisposition regarding the Part 1 application, including the need for a public hearing regarding the cancellation of original local third-language newscasts by Rogers on its OMNI stations.  The Commission will make its determination on that application based on the full record of the proceeding and will issue its decision in an expeditious manner following the close of record.
