Cogeco Cable Inc. – Revised capacity-based billing rate

  1. The Commission received an application from Cogeco Cable Inc. (Cogeco), dated 20 June 2014, in which the company proposed modifications to its Third-Party Internet Access (TPIA) Service Tariff to reduce the monthly capacity rate per downstream capacity increment of 100 megabits per second (capacity-based billing [CBB] rate) from $2,556.00 to $1,673.63.
  2. The Commission approved Cogeco’s application on an interim basis in Telecom Order 2014-369, effective 14 July 2014.
  3. Cogeco filed an amendment to its application, dated 12 January 2015, proposing a new lower CBB rate of $1,411.17. Cogeco submitted that it was filing the amendment as a result of work it had carried out in responding to a request for information from Commission staff dated 21 November 2014.
  4. In Telecom Order 2015-22, the Commission approved Cogeco’s amendment on an interim basis, effective 14 July 2014.
  5. The Commission received interventions regarding Cogeco’s application from the Canadian Network Operators Consortium Inc. (CNOC), Nexicom Inc., TekSavvy Solutions Inc., and WTC Communications.   6. In its intervention, CNOC submitted that there were several errors in Cogeco’s costs model that, if corrected, would result in a CBB rate lower than that proposed in Cogeco’s amendment.
  7. Cogeco replied that it agreed with CNOC’s submission. Specifically, Cogeco acknowledged that there were errors in its costs model regarding (i) the calculation of income taxes, and (ii) the use of the productivity improvement factor. Cogeco made corrections to its costs model, and submitted that the overall impact of the corrections is a reduction in the CBB cost. Cogeco filed a revised costs model reflecting these corrections, and requested that the Commission approve on a final basis a new revised CBB rate of $1,181.79 per month, effective 14 July 2014.
  8. Based on the record to date, the Commission approves on an interim basis a revised CBB rate of $1,181.79 per month for this component of Cogeco’s TPIA service, effective 14 July 2014.
