CKYK-FM Alma and its transmitter CKYK-FM-1 – Licence amendment

The Commission approves the application by Groupe Radio Antenne 6 inc. to amend the broadcasting licence for the French-language commercial radio station CKYK-FM Alma to allow it to devote more than 50% of the broadcast week to spoken word programming for the purpose of broadcasting Montréal Canadiens and Chicoutimi Saguenéens hockey games during any broadcast week where it owns the broadcast rights for these games.

Application

  1. The Commission received an application by Groupe Radio Antenne 6 inc. (Antenne 6) to amend the broadcasting licence for the French-language commercial radio station CKYK-FM Alma and its transmitter CKYK-FM-1 Alma to authorize it to devote more than 50% of the broadcast week to programs drawn from content category 1 (Spoken Word) for the purpose of broadcasting Montréal Canadiens hockey games. The Commission received joint interventions supporting this application.
  2. Specifically, Antenne 6 requested that the Commission amend the following condition of licence imposed in Broadcasting Decision 2014-482:

    The licensee is authorized to devote more than 50% of the broadcasting week to programming from content category 1 (Spoken Word) as defined in Revised content categories and subcategories for radio, Broadcasting Regulatory Policy CRTC 2010-819, 5 November 2010, for the sole purpose of broadcasting Chicoutimi Saguenéens hockey games during any broadcast week in which it holds the broadcasting rights for these hockey games.

  3. The licensee stated that this amendment would meet a need expressed by the community. However, it added that priority would be granted to Chicoutimi Saguenéens games and that those of the Montréal Canadiens would only be broadcast when the Saguenéens did not have a scheduled game. Each game would be accompanied by a pre-game and a post-game program.

Commission’s analysis and decision

  1. CKYK-FM operates as a non-specialty commercial radio station broadcasting an Alternative Rock format. The definition of a station operating under the specialty format is set out in Public Notice 1995-60, as amended by Broadcasting Regulatory Policy 2010-819.
  2. In Broadcasting Decision 2014-482, the Commission approved an application by the licensee to authorize it to exceed, in any broadcast week in which it holds the broadcast rights for Chicoutimi Saguenéens hockey games, the maximum level of spoken word programming that the station is authorized to broadcast, namely 50%. The Commission therefore imposed the above-noted condition of licence on Antenne 6.
  3. In the current application, the licensee indicated its intention to broadcast two to six games per broadcast week and estimated that its weekly level of spoken word programming broadcast during the hockey season would vary between 45.2% and 56.2%. Therefore, at its highest level, this percentage would go beyond the allowed threshold by 6.2%.
  4. Consequently, the Commission finds that it would be appropriate to authorize Antenne 6 to exceed the maximum level of spoken word to allow CKYK-FM to broadcast Montréal Canadiens hockey games. The Commission also reminds Antenne 6 that it committed to prioritizing the broadcast of Chicoutimi Saguenéens games.

Conclusion

  1. In light of the above, the Commission approves the application by Groupe Radio Antenne 6 inc. to amend the broadcasting licence for the French-language commercial radio programming undertaking CKYK-FM Alma and its transmitter CKYK-FM-1 Alma to authorize it to devote more than 50% of the broadcast week to programs drawn from content category 1 (Spoken Word) for the purpose of broadcasting Montréal Canadiens hockey games.
  2. Accordingly, the Commission amends the condition of licence imposed on CKYK-FM in Broadcasting Decision 2014-482 as follows (change is in bold):

    The licensee is authorized to devote more than 50% of the broadcasting week to programming from content category 1 (Spoken Word) as defined in Revised content categories and subcategories for radio, Broadcasting Regulatory Policy CRTC 2010-819, 5 November 2010, for the sole purpose of broadcasting Chicoutimi Saguenéens and Montréal Canadiens hockey games in any broadcast week in which it holds the broadcast rights for these hockey games.
